“MRS PALMERS WAX UP AND WIN” PROMOTION
HOW TO ENTER
To be eligible to enter, individuals must purchase any packet of specially marked Mrs Palmers surf wax bars from a participating retail store between 01/11/09 and 5pm AEST on 30/06/10.
Entrants must then look inside their specially marked packet to see if they have a token.
Prize Claims:
Wax Bar Prizes: If the entrant finds a token with a message stating that they have won a ‘Mrs Palmers Wax Bar’, the entrant must present their winning token to a staff member at a participating retail store before 5pm AEST on 30/06/10.
All Other Prizes: If the entrant finds a token with a message stating that they have won a prize (other than a ‘Mrs Palmers Wax Bar’), the entrant must register their claim online by visiting www.palmerssurf.com.au and following the prompts to the competition entry page, inputting the requested details including their personal details and the five (5) digit code revealed on their token, before 5pm AEST on 30/06/10.
The provisional winner of the major prize (i.e the trip to Hawaii) will be required to provide the Promoter with their original token as proof of purchase and proof they have won the prize. The Promoter will liaise with the provisional major prize winner to determine the best way to deliver the winning token to the Promoter.
Individuals that do not find a promotional token in their specially marked Mrs Palmers surf wax bar will not win a prize.
Individuals who purchase a packet of specially marked Mrs Palmers surf wax bars from a participating retail store during the promotional period can also enter the unclaimed prize draw by visiting www.palmerssurf.com.au and following the prompts to the competition entry page and inputting the requested details before 5pm AEST on 30/06/10.
TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian and New Zealand residents.
Employees (and their immediate families) of the Promoter, participating retailers, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Promotion commences on 01/11/09. All claims (excluding claims for Mrs Palmers wax bars) must be registered online by 5pm AEDST on 30/06/10. All claims for Mrs Palmers wax bars must be received at a participating retail store by 5pm AEST on 30/06/10.
Instant winners will be notified immediately in writing. The names of the winners (for prizes over $250) will be published in the #43 July/August issue of Stab Magazine and in The Australian on 14/07/10.
The Promoter’s decision is final and no correspondence will be entered into.

The trip prize includes return economy airfares from winner's nearest capital city (if winner resides in Australia) or from Auckland (if winner resides in New Zealand) and seven (7) nights twin share accommodation at a four (4) star rating accommodation. Spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 04/01/11 and is subject to booking and flight availability. Prize cannot be taken during Australian or New Zealand school holidays, public holidays or peak periods.
The winner (and his/her companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner (and his/her companion) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present a credit card at time of accommodation check in.
If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $20,221.07.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed or un-won prizes may take place on 30/09/10 at 5pm at Network Surf, 1 Billabong Place, Burleigh Heads, QLD 4220, subject to any directions from a regulatory authority. Winners’ names (for prizes over $250) will be published in The Australian on 08/10/10.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Any unclaimed or un-won instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) use of a prize.
As a condition of accepting the major prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
